So, sounds like a few things happened.

 

First, the court agreed 5-0 that the original RSDC decision should be overturned due to evident partiality. My understanding is that means this decision can no longer be appealed. That's a win for MASN. More importantly, that's a win that can be banked.

 

Second, the court decided 3-2 that the RSDC is the appropriate venue for a new arbitration. That's a win for the Nationals/MLB. Since this was decided 3-2, this decision can and will be appealed. So, a small win for the Nationals. But it's a win that has little meaning. Still, it's a pretty big moral win, as these things go.

 

The court decided that the RSDC can be trusted to rule fairly this time around, even though they were biased by MLB the first time around because the members are different. Courts don't want to change the arbitration venue when parties agree upon it unless absolutely necessary, so they weren't going to do so unless they absolutely felt they had to do so. 

 

They further felt that the $25 Million that MLB gave the Nationals was to help reach a deal, and therefore didn't want to punish MLB for this payment. It's a bit unreasonable to claim that the Nationals agreeing in oral court to repay the $25M before a hearing in front of the RSDC would be enough to remove MLBs bias. 

 

The court also questioned whether MASN would be happy with an "independent" panel. Any such panel would have to have some connection to MLB, because the arbitrators need to be experts in MLB. 

 

The other judges felt that MLB is going to bias the RSDC, and that MASN can't get a fair hearing. 

 

Going forward, there will be another appeal. My understanding is that this will take us to 2019. Before then, MASN will renegotiate its contract with Comcast. Depending on the outcome of that negotiation, MASN may very well lose significant value. The longer this goes on, the more likely the Nationals never see increased rights fees.

The Rays are entering the final year of their current deal on Fox Sports Sun. The team is due to receive close to $35 million this season, the last one under that deal, sources said.

Fox’s payout is expected to increase to around $50 million in 2019 under the new contract. Over the 15-year life of the deal, which would run through the 2033 season, Fox would pay, on average, around $82 million per year, sources said.

Orioles pitched settlement offers to eliminate cloud of MASN dispute with Nats

 

Interesting.

 

No idea what the details are.  I'd probably suggest some things that might not be included, but its good for the Orioles to try some resolution out of court.

 

At some point, if the Orioles appear to be the more reasonable party (especially with the initial agreement on their side), that should bode well for them in an arbitration hearing.

Unless I misunderstood, the article was saying that the O's previous settlement offer, was only slightly modified from the offer before that. And that was the offer that was rejected. The O's latest offer is to immediately give the Nats a 33% ownership stake, something that wasn't due to happen until 2032. So this is a considerable concession.

Within the context of the article, the previous proposals were to increase the ownership stake by percentage points that exceeded the agreed upon triggers. This is totally different. They're offering the full 33% right now, 14 years earlier than the original terms. 

If the Nats are saying this offer has been given before, and they're rejected it, that would suggest they want to rip up the existing contract, and negotiate all new terms today.

Wasn't this supposed to be settled?  3 Weeks later and I haven't heard anything more on this.

Yeah, it turned out that those were just oral arguments.  I think written arguments are due later this month, and then the RSDC will decide at some undetermined point.
