From what I read, sounds like the issue was that the Philly DA originally agreed not to prosecute, so that Cosby couldn't plead the 5th in any civil cases.  The DA thought there was a better chance of justice being served in civil courts.  But then a new DA took incriminating statements that Cosby made in the civil cases, and used them to prosecute.  The PA Supreme Court didn't like that.

What a mess. Sloppy work by the prosecutors, both past and present. Can't imagine how awful this must feel for all the victims who thought justice had been served.

The justices said that overturning the conviction, and barring any further prosecution, “is the only remedy that comports with society’s reasonable expectations of its elected prosecutors and our criminal justice system.”

If nothing else, the trial and conviction proved what a lowlife Cosby is.

That said, I can see where his right to due process was impeded by the prosecutor. If there was an agreement between Cosby and the previous DA than he should not have been prosecuted.


Lucky for him he has millions and he was able to take his case to the highest level in the state. Makes you wonder how many people ( who don't have the money and influence) are railroaded.

That's the entirely unfair part of this. 

 

I mean anybody with sufficient financial backing (either individually or unionized) can fight an injustice, but, again, it shows how these disparities can wreck people, families and communities.

Absolutely.   

Of course, if he wasn't rich and famous, he probably wouldn't have gotten the deal from the 1st DA that got him out of jail either... so, his money and fame made it work on both ends of this whole mess...  

BTW, the deal he got from the 1st guy was so he could testify without worrying about his testimony in civil suits coming back to haunt him in a criminal case... but in that jurisdiction he never admitted anything at all... so he got a guarantee for doing nothing.  Plus this guarantee was never formally written up... the only trace of it is in a dang press release... which is why the lower courts didn't buy it...

 

The only silver lining is that he is now not just famous but also infamous... this court decision does nothing to clear his name...

This Cosby thing just gets better and better...

 

The goofy DA who gave Cosby that so-called immunity deal while getting absolutely nothing in return for it... it was Bruce Castor... who you might remember as the comically clueless lawyer representing Trump in his 2nd impeachment trial...

 

You couldn't make this stuff up...

For someone who didn't follow that trial closely....did Cosby's defense attorneys bring this up during the trial in order to ensure that deposition testimony wasn't admitted? If not, why? If so, why did the judge allow it? Seems to me that would be immediate grounds for a mistrial. Someone ought to have to answer for this, and personally apologize to all the victims.

I would imagine a deal like that is not at all uncommon in sexual assault cases that are usually difficult to prosecute. I put it more on the DA that prosecuted Cosby. It seems like something a first-year law student could see and realize you can't admit as testimony.

Of course he's gonna claim that... he's a weasel...  but that so-called deal (which was never even written up) obtained nothing in the trial... Cosby denied everything... so I'm not sure what about it he might be proud of... he got zero of any benefit in return for it...
